Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and EstFlux ("EstFlux", "we", "us") governing your access to and use of EstFlux's VPS hosting services, website, control panel, and all associated products. By registering an account or using any EstFlux service, you agree to these Terms in full.

1. Acceptance of Terms

To use EstFlux services you must be at least 18 years of age or the age of majority in your jurisdiction, and capable of entering into a binding legal agreement. If you are entering into this agreement on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Services

EstFlux provides KVM-based virtual private server (VPS) hosting from our data center in Tallinn, Estonia. Services include:

• Virtual server instances with dedicated CPU, RAM, and SSD storage as specified in your chosen plan
• Dedicated 500 Mbit/s network uplink per server (fair-use applies — see Section 7)
• Daily automated backups included with all plans
• IP address allocation (IPv4 and/or IPv6)
• Customer control panel for server management
• Technical support via email and ticket system

Service specifications are detailed on the plans page at estflux.com/plans. We reserve the right to update plan specifications for new orders; existing subscriptions are not affected by changes to published plan details unless we notify you in advance.

3. Account Registration

You agree to:

• Provide accurate, current, and complete information when registering
• Keep your account credentials secure and not share them with unauthorized parties
• Notify us immediately of any unauthorized access to your account
• Maintain accurate contact and billing information at all times

You are responsible for all activity that occurs under your account, whether or not you authorized it. EstFlux is not liable for losses resulting from unauthorized account use.

4. Billing and Payment

4.1 Subscription and Invoicing

Services are billed monthly in advance. Invoices are issued at the start of each billing cycle. Payment is due upon invoice issuance.

4.2 Accepted Payment Methods

We accept major credit and debit cards, and other payment methods as displayed at checkout. All transactions are processed in Euros (EUR).

4.3 Late Payment

If payment is not received by the invoice due date, the service is suspended immediately. Services suspended for non-payment are permanently deleted on the 7th day after suspension. We will send email reminders before suspension.

4.4 Refund Policy

All payments are non-refundable except where required by applicable law. Refunds are not issued for suspended or terminated accounts due to AUP violations.

4.5 Taxes and VAT

Prices displayed are exclusive of applicable taxes. EU-resident customers may be subject to VAT. If you have a valid EU VAT number, provide it during registration to receive VAT-exempt invoices.

5. Acceptable Use Policy

You may use EstFlux services for any lawful purpose that does not harm others, our infrastructure, or our ability to provide services to other customers. You are responsible for ensuring all activity on your server complies with applicable laws in Estonia, the EU, and your own jurisdiction.

6. Prohibited Activities

The following activities are strictly prohibited:

• Network abuse: sending unsolicited bulk email (spam), operating open mail relays, conducting DDoS attacks or participating in botnets
• Illegal content: hosting, distributing, or facilitating access to content that is illegal under Estonian or EU law, including but not limited to child sexual abuse material (CSAM), terrorist content, or content infringing third-party intellectual property rights
• Hacking and intrusion: unauthorized access to systems, port scanning third-party networks without permission, credential stuffing, or similar activities
• Cryptocurrency mining: unless your plan explicitly permits high sustained CPU usage, cryptocurrency mining operations that impact shared infrastructure
• Phishing: operating sites designed to deceive users into providing credentials or payment information
• Fraudulent activity: any activity intended to defraud EstFlux or its payment processors

7. Network and Bandwidth

Each EstFlux server includes a dedicated 500 Mbit/s uplink. This means the physical port is not shared with other customers. However, fair-use principles apply:

• Sustained traffic that materially impacts the network quality of other customers may be subject to temporary rate limiting
• We do not impose monthly traffic caps for normal usage
• Traffic that constitutes a DDoS attack or network abuse is subject to immediate filtering or suspension regardless of origin

EstFlux reserves the right to null-route or filter IP addresses under active DDoS attack to protect network stability.

8. Suspension and Termination

8.1 Termination by You

You may cancel your service at any time via the control panel or by contacting support. You choose how cancellation is processed:

• End of billing period: the server remains active until the end of the paid period, then is deleted.
• Immediate deletion: the server and all its data are deleted right away. No partial-month refund is issued.

8.2 Suspension by EstFlux

We may suspend your service immediately, with or without prior notice, if:

• Your account is involved in a network abuse incident
• Your server is the source of a DDoS attack
• We receive a valid legal order requiring suspension
• Your payment is overdue — suspension occurs on the day of non-payment

8.3 Termination by EstFlux

We may terminate your account with 14 days' notice for any reason, or immediately without notice for serious AUP violations. Upon termination, all server data is deleted immediately.

9. Snapshots and Data

EstFlux provides a snapshot feature as a convenience tool. Every plan includes 1 free snapshot slot. Additional slots are available at €1 each, up to 5 total. Auto-snapshots (daily) can be enabled in the control panel — they are not active by default.

Snapshots are not a substitute for your own backups. EstFlux does not guarantee snapshot availability, integrity, or completeness. You are solely responsible for maintaining independent copies of your data. EstFlux is not liable for any data loss.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• EstFlux's total liability for any claim arising from these Terms or service delivery shall not exceed the amount you paid for the affected service in the 3 months preceding the claim
• EstFlux is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption
• These limitations apply regardless of the form of the claim (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages

11. Disclaimers and Warranties

Services are provided "as is" and "as available". EstFlux makes no warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose. We do not warrant uninterrupted or error-free service. Our uptime commitments are set out in the SLA at estflux.com/legal/sla.

12. Intellectual Property

All content on estflux.com — including text, design, code, trademarks, and the EstFlux name — is owned by or licensed to EstFlux. You may not reproduce, distribute, or create derivative works without our written permission. You retain full ownership of all content and software you deploy on your VPS instances.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered customers at least 14 days before taking effect. Continued use of services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you may cancel your account before the effective date.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia. Nothing in this section limits your rights as a consumer under applicable EU law.
